I think it is FAT16 - but it will be filled by the hibernation file, so 
there is no advantage to using FAT32.

No, it must be the first, with the BM partition afterwards.  That shouldn't 
affect Windows, since it can put the NTLOADER files on the same partition as 
the hibernation partition.
